These Terms of Service are effective as of November 1, 2025.

You must be at least 13 years old to use Musicbuff. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into these terms. If you are under 18, you must have parental or guardian consent to use our services.

Musicbuff is a live music streaming service that connects artists with audiences through real-time performances. Our service allows users to discover, watch, and interact with live musical content while providing artists with tools to broadcast their performances and engage with their fanbase.

Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. You agree to use the service in compliance with all applicable laws and regulations. Users must not engage in harassment, spam, or any behavior that disrupts the service experience for others. You are responsible for ensuring your internet connection and device meet the technical requirements for streaming.

Artists retain ownership of their original musical content streamed on Musicbuff. By using our service, artists grant Musicbuff a limited license to host, stream, and distribute their content through our service. Users may not record, download, or redistribute streamed content without explicit permission from the content owner. Musicbuff respects intellectual property rights and will respond to valid copyright infringement claims in accordance with applicable law.

Musicbuff reserves the right to enforce these terms through various means, including but not limited to warnings, temporary suspensions, or permanent account termination. We may investigate violations and take appropriate action at our discretion. Users have the right to appeal enforcement actions through our support channels. Repeated violations may result in permanent removal from the service.

Musicbuff may offer monetization features for artists, including but not limited to virtual tips, subscription services, and advertising revenue sharing. All monetary transactions are subject to our payment processing terms and applicable fees. Artists are responsible for reporting income and paying applicable taxes on earnings from the service. Musicbuff reserves the right to modify monetization features and fee structures with appropriate notice.

Musicbuff is provided "as is" without warranties of any kind, either express or implied. We do not provide assurances of uninterrupted service, error-free operation, or that the service will meet your specific requirements. Users acknowledge that live streaming involves inherent technical risks and that service quality may vary based on internet connectivity and other factors beyond our control. To the maximum extent permitted by law, Musicbuff shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes but is not limited to loss of profits, data, or use, arising out of or relating to your use of the service. Our total liability for any claims shall not exceed the amount paid by you to Musicbuff in the twelve months preceding the claim. Musicbuff is not responsible for content created by users or third parties.

Either party may terminate the service relationship at any time. Users may delete their accounts through the service settings. Musicbuff may terminate accounts for violations of these terms or for any reason with appropriate notice. Upon termination, users lose access to the service and any associated data, though artists retain ownership of their original content. Certain provisions of these terms will survive termination, including intellectual property rights and limitation of liability clauses.

Musicbuff reserves the right to modify these Terms of Service at any time. Users will be notified of material changes through the service or via email. Continued use of the service after changes constitutes acceptance of the modified terms. If you disagree with changes, you may terminate your account. We encourage users to review these terms periodically to stay informed of any updates.

These Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from or relating to these terms or your use of the service shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware. For users outside the United States, local consumer protection laws may apply where required by applicable law.

Before initiating any formal legal proceedings, parties agree to attempt resolution through good faith negotiation. If direct negotiation fails, disputes may be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Users retain the right to pursue claims in small claims court for matters within that court's jurisdiction. This arbitration clause does not apply to claims related to intellectual property rights or injunctive relief.
